The Allahabad High Court has sought Centre’s stance on a PIL seeking a CBI probe into Congress leader Rahul Gandhi’s alleged British Citizenship.
The Delhi High Court gave BJP’s Subramanian Swamy time to submit a digital copy of a related case in the Allahabad High Court about Congress leader Rahul Gandhi’s citizenship. Earlier, the court noted that two courts shouldn’t handle the same issue simultaneously.
Swamy told the court he had obtained the Allahabad High Court case details and explained that it differed from his arguments.
Chief Justice Manmohan and Justice Tushar Rao Gedela asked Swamy to submit the documents electronically and set the next hearing for November 6.
Swamy’s petition asks the court to direct the Home Ministry to address his request to revoke Gandhi’s Indian citizenship. He’s seeking an update from the ministry about his complaint against Gandhi.
Swamy claims he wrote to the Home Ministry on August 6, 2019, alleging Gandhi had told the British government he was a British citizen, suggesting he held a British passport.
Separately, the Allahabad High Court asked for the government’s position on a plea by a Karnataka BJP member. This plea seeks a CBI investigation into Gandhi’s alleged British citizenship and its cancellation.
Justices Rajan Roy and Om Prakash Shukla asked the government’s lawyer to get information from the Home Ministry. The petitioner said they had written to the ministry’s Foreigners Division.
The Allahabad High Court inquired about the government’s planned response to the petitioner’s submission under the Citizenship Act, 1955.
